Why Xbox 360 gets CoD DLC before PS3

The release of the official MW3 season content calendar has fired off a new volley of comments, questions, and confusion from PlayStation 3 gamers. The main question: “You said I would get content early. I paid for Elite just like the Xbox 360 gamers; why do they get content first?” A good question, and one that has a clear answer, I’m happy to say.

Back in 2010, Activision and Microsoft entered a business deal to release DLC on Xbox 360 earlier than other platforms; this contract is valid through the year 2012. This business deal was very widely reported by the games media when the announcement was made at E3 in 2010, and the DLC releases for both Modern Warfare 2 and Call of Duty: Black Ops was released in accordance with that contract. All DLC for MW3 will follow the terms of that deal as well, because it’s still 2012.

This is the short answer. Read on if you would like the long answer.

Exclusivity in the game biz is not uncommon, whether it’s a game franchise only appearing on one platform (Gears of War for Xbox 360, Infamous for PlayStation 3) or content that is only available to one audience or the other (Darth Vader and Yoda in Soul Calibur IV on PS3 and Xbox 360, respectively). Sometimes, as with Soul Calibur IV, this exclusive content eventually shows up on other platforms. Sometimes, as with Kratos in Mortal Kombat or the playable Joker in Batman: Arkham Asylum, it does not.

Thankfully, for Call of Duty DLC, all consoles get all the same content, but there is a delay as to who gets what when. This type of exclusive is not that uncommon either; other games, such as Battlefield 3 and Skyrim, have also arranged timed exclusives, anywhere from a week to a month. Eventually, though, everybody gets everything.

Enter Call of Duty Elite. Premium members pay $49.99 up front and get all the MW3 DLC that will come out over a nine-month period — DLC that Eric Hirshberg said at XP 2011 would cost $60 if it was bought via traditional map pack bundles. Even if you didn’t care about anything else that Elite premium offers, that’s a no-brainer for dedicated CoD players. But somewhere along the way, people convinced themselves that an Elite subscription would trump the 2010 DLC exclusivity deal that was created before Elite existed — that by paying for Elite, they were somehow invalidating a contract between Activision and Microsoft. It doesn’t make any sense, but it is what people started to think.

I wondered where people would have gotten that idea — had someone actually promised that, or said something at XP 2011 that I missed? — so I researched it. What I found was that you can’t prove the non-existence of something. I can find no evidence of “buy Elite, get PS3 DLC same time as 360″ ever being so much as suggested by any official source. It was never one of the things listed in the official benefits chart; it was never promised by any representative of Activision, Call of Duty, Elite, or its developers. Honestly? I think gamers just convinced themselves that it would happen because they wanted it to happen. That makes sense, but it doesn’t make it true.

Still, the Call of Duty team must have known this assumption could be a source of confusion. So the Elite FAQ is very clear:

Similar to Map Packs, X360 Premium members will receive their Content before PS3 Premium members. All Call of Duty ELITE Premium members will receive a steady stream of content released monthly for 9 months through the Content season, and they will also receive their Content before non-premium members on their console.

I know I am not everybody’s primary source of Activision information, but I also noted this back in June 2011 in my massive “What I Know About Call of Duty Elite” article:

Elite subscribers will be able to access the DLC before it goes on sale to a la carte purchasers. The window of time has not been disclosed. For PS3 owners, this does not override this business deal that currently brings Call of Duty DLC to Xbox 360 first; that deal is valid through 2012. However, Elite members will get the DLC before the non-Elite members on their respective platforms.

So…that’s where we are. The deal from 2010 is why DLC comes out on Xbox 360 first. I’m seeing people scream “rip-off” and stuff like that, but nobody’s going to get ripped off; every gamer will get everything they were promised and everything they paid for. It’s unfortunate that people assumed things about Elite that turned out to not be based in fact, but I hope the truth is clear now. Unpopular, I’m guessing, but clear.

Also, you don’t have to pay to play Call of Duty multiplayer. But everybody knows that now, right?

UPDATE 1/28: I’m sorry to see people taking this article the wrong way. My intent was not to be mean or arrogant; my intent was to clear up the confusion and dig into how we got to this point, because ultimately this is a case of what was said vs. what was assumed. That’s always difficult.

But sorting out the facts does not mean that I don’t understand how frustrated people are. I totally get where the confusion came from; it makes sense and I totally understand why people are upset — and I am sorry about the situation. But I think the flames are starting up now because people wanted to hear something else, and I can’t say what they want to hear. I’m sorry about that, too. All I intended to do was offer the facts and show my work, and I had hoped being clear would be helpful to people who were still confused and asking me about it on Twitter. Perhaps not, in hindsight. So if you need to rage at me about it, okay.

    The way things have been worded by Activision still sounds like even Xbox non premium members will receive content before PS3 premium members. They just aren’t flat out stating because of the obvious fallout that will ensue.

    Just to add one more point Dan, according to IW you Activision is also withholding technical updates to the PS3 platform of the game, since they include “exclusive content” for PS3 users.  I find that with holding technical updates on software is extremely unethical.

    You’ve left other platforms out in the dark as to when the DLC will be released, that’s not fair to those who have paid for premium services. There’s also a consumer rights issue involved with this “communications” crisis that Activision has no one to blame but itself for “inventing”.  Question becomes, how are you going to deal with this.  I think that gamers in general are getting a little fed up with being pushed around by Activision.  There’s something called “customer service”, but yeah I forgot, anyone who quotes customer service reps is wrong too, and a lacks good journalism skills:

    OMG did we pay for a Premium service that adds a further 30 day (now 60 days) to the release of maps?

    At no point was the delay apparent at the point of sale from PSN. To say we (us PS3 gamers) should have known about it because of a past deal is pathetic and won’t hold up.

    you said it yourself though Dan, he DOESN’t say it, that’s exactly everyone’s point. He SHOULD have specified that 360 premium members were going to get it before PS3 premium members, but insteead, he was speaking in general of premium vs non-premium, and there lies the confusion, as when people bought the premium/hardened on PS3, they thought they  were getting it early LIKE 360, not after 360.  but again, no qualms from me that way, as I know what content I’ve paid for, and figured this would happen. I’m more glad I’m saving money on DLC and getting chances to participate in Ops for prizes.  the whiners out there, geez.

    I am a huge fan of COD in PS3, I understand the deal with microsoft for the month of exclusivity, but in the COD XP you said that the clans on elite will be functional, and they aren’t, elite have a lot of issues and is never working correctly, i only ask for better service on my subscription with elite, now its two months after release and i don’t see any improvements on it.

    your right we shouldn’t have assumed that we would get the maps at the same time……but I think I was right assuming or at least hoping that the cod elite service would actually work for shit within 3 months after I started paying for my subscription to it. ohhhhh snap! you got served!

    Dan, you do make a valid point. I as a PS3 user and a COD gamer of 4.5 years get it! But I would like to say that in the last 2 plus years, I never heard of the specifics to the Microsoft contract, until today..

     It would have been the right thing for Activision, Infinity Ward, Beachhead Studios etc to just be completely open about all the terms. Why should I have to dig through the FAQ’s or twitter accounts to get the information?

    An * with some small text on the posters, TV commercials (perhaps advertise towards the XBOX 360 specifically and state that as a XBox360 member they get the DLC 30days before anyone else. I would have seen that one and gotten it right there and then..No confusion!) or anything else stating the facts not just about the DLC but even the Elite Clan Challenges, the postponed mobile app (now the app with half the features, only good if you want change your weapons class or get your stats)

    The bottom line is, I paid for the hardened edition for one main reason to have Clan Challenges and save a few bucks one the DLC. We are three months in to it and still no Clan Challenges. 

    I during the preorder period was led to believe that Clan Challenges, mobile app would be ready to use and dive in when the games started shipping..No mention of it otherwise was ever mentioned. Not at game stop, Amazon, Best Buy etc….

    Myself, along with a lot of other people have paid good money for a product that promised to deliver great features but lacks vastly in it’s execution. Take the Phone app as another example, can’t send other people invites to my clan, I have to log in from a browser to be able to do that so what’s the point of having the app then? To check my stats or change a weapons class? Wow, i’m impressed. very useful.The app and the game should have had all the advertised features built in, and ready to be launched before the game even sold one copy. The same goes for Clan Challenges. If the past has indication on the present and future of the franchise of COD, The one main thing that I would walkaway from if I was Activision is… They will sell millions, and in this case a billion copies of the game in a very very short amount of time.. So… knowing that, why wouldn’t Activision want spend some extra money upfront and outsource the different aspects of the games’ features to have a complete game experience at launch to avoid issues like this and end up driving people away from the game.IMHO, I still think that BlackOps has been the best COD game to date, MW2 the worst and MW3 not far behind. Perhaps it time we COD gamers look to a new franchise with the hopes that maybe one day Activison will get it’s ducks in a row. Until then, I hope that other game developers will learn from the rise and fall of Activision.

    At no point was it apparent to me at the point of sale from the PSN store that the content would be delayed by 30 – 60 days. I don’t know if PSN restricts Activision from mentioning XBL on PSN.

    Dan…you’re a jerk.  At least your blog comes off as incredibly smug, especially the “you don’t have to pay to play online” bit at the end.  Of course we do, moron…it’s part of the $60 that we paid to get the game in the first place.  Not sure how that didn’t occur to you, but that’s not my point.

    My point is this:  I’m a big CoD fan.  I’ve bought every CoD and all the DLC for each game on BOTH PS3 and 360 since CoD4.

    But I don’t like jerks.

    The PS3 Elite subscribers who complained about timed exclusivity are perfectly within their rights to do so.  Your attitude is one of condescension…like you’re better than all of us.

    I know…you didn’t mean it.  That’s BS.  You did, and we all know it.  That smarmy last part of your blog is pretty much proof of it.

    So guess what…no more.  No more CoD, no Elite, no DLC for the CoD I already own…and no more Activision games whatsoever.

    So basically…I will not be paying for ANY Call Of Duty games or content…ever again.  But everyone knows that now, right?

    You can point fingers as much as you want, but in reality, if the customer
    didn’t know after 2 games of DLC’s worth of delays on the PS3 end because of
    this contract, then it really does come down to the consumer being at fault. 
    I’m in no way defending Activision’s position on this, as they could have done a
    better job getting this message out.  But seriously, if you’re that concerned
    about not getting the NEW DLC right away, and having to wait like another month
    after Xbox when you’re STILL GETTING THE DLC BEFORE EVERY OTHER PS3 USER, as
    well as GETTING ALL THE DLC BEFORE YOUR SUBSCRIPTION IS UP, then you need to
    rethink your priorities in life….

    Suggestion 1 – what will getting a free month do?  Regardless of the shortened DLC season, PS3 players STILL GET ALL THE CONTENT. You are NOT being shorted any content, even though you have to wait longer for it.  And all other aspects of the Elite service are equal for both consoles.  So what “injustice” does this correct?

    Suggestion 2 – you are requesting a refund on the basis of the GAME manual not saying anything about the DLC for ELITE subscriptions? Why would that be in the GAME manual?  Wouldn’t that information be in the ELITE literature?

    Suggestion 3 – While this seems like a good idea, the Elite subscription (you know, that thing you all paid for that entitles you to the content) is tied to the PSN ID.  It is also clearly stated on the Activision support site, as well as in Section A2 of the Elite terms and conditions (http://www.callofduty.com/elite/terms) that this is NOT transferable.  So while you will now own the game on XBox, you won’t have the premium subscription on XBox, and will thus STILL not get the content.
    “and as it wasn’t mentioned anywhere their terms and conditions are void” – it has been pointed out several times in this thread that this info IS in the Elite FAQ.

    And finally, you mention many times that they will change their tune if you mention a lawyer or a law suit… HAHAHAHAHAHAHAHAHAHA!!!!

    Thank you for that information, in all fairness u were trying to convey the business understandings of this. the bottom line the psn users feel were that information was never given to clarify this prior to sells, also the problem is with the lack of promises made, such as clan opperations and monthly dlc, all the information was promised then later is was said, “at a later time it will be running” or “during the 9 month dlc season” it was very unclear, and no other game does that, even under activision such as blizzard, they flat out say, no its not done and we won’t release til its perfect, like the release of diablo3, it is delayed again cuz it needs more work, us who buy cod and elite want that same motto, delay it or tell us the truth, i don’t care that i get my dlc a month later, but i do care that i was never told anything and it was very hazy and not clear. make it clear with direct statements. bathesda lead creator made it clear skyrim will be much better on pc, but was advertised for xbox, we understand money we get that, but we want truth. tell us specifics, like now they say “shortly after” for dlc on ps3, most of us know it will be a month, but tell us, at least we know, its with holding information that is bad, and us who are fans are prolly going to leave our fps games this upcomming year for maybe EA. i didn’t want to buy and play battlefield but i did and am prepareing for the next one, and i think i speak for 100′s of thousands of people, or at least in the countless lobbies i have been in and my 20+ elite member clan are def making a transition, but we don’t want to, but unfortunatly we will

    ACTIVISION consists a bunch of theives, who (A): deliberately used false advertising to sell their product, or (B): unintentionally mislead PS3 gamers, with phrases like “tired of the wait? with elite you don’t have to.” who are too proud to say I’m sorry, or OOPs we forgot to mention about the X-Box deal. I, personally think they were to busy drooling over all of their money to give a shit either way. But everyone gets what they deserve, one day, in some fashion or another.     But xbox pay to get more earlier release date one month before i think this will help people to understand more the concept. so no they dint lie about elite premium they just released 2 month before for xbox because they got partnership :)  i hate xbox haahha

Gamestop and its employees DEFINITELY advertised Elite as and I quote “…as an Elite Premium member you enjoy DLC and maps FIRST” there is no asterisk or further explanation that states “xbox360 gets first first” and further.. Ive made screen prints and paper prints of the repeated ads showing a matrix that explains what Elite Free gets and what Elite Premium gets.. and the lack of asterisks or clarifications.. meaning there is INTENT to mislead PS3 players and part them from their money on the basis of false advertising. Activision clearly allowed these representations to continue as it is the source of these ads, and then hides behind the “previous contract” defense… which has summarily and repeatedly been dismissed by the courts as “no defense against fraudulent advertising”.. oh and Dan.. can you guess what I do for work when Im not a PS3 player? Hint: suit, tie, courts… win 92% of my cases

Before offering NEW services to NEW clients and asking NEW funds be given.. a product must work and be known to work for ALL of your previous clients.. and it simply doesnt. At last count Elite was off on my stats EVERYWHERE and off on my kills by over 6000 (it doesnt credit bouncing betty and grenade kills for PS3 players apparently?? Ill get 23 kills in a round, say 3 are by grenade or betty, on elite it says I had 20 kills.. but a score of 2300??) The sole, simple, and basic function of Elite was to track stats.. IT DOESNT.. and that is known to Activision, very well. Its other purpose was for clan play, and that is down so often its sickening.

    Nearly 4 months into 12 of my PAID SUBSCRIPTION and I have yet to have the product I paid for…a) work.. b) deliver on what was promised and c) do anything close to what it advertises..Sounds like a prima facie case of fraud actually… that means TEXTBOOK EXAMPLE THATS SO OBVIOUS NO CASE IS REALLY NEEDED ;)

    Dan you consistently through all of these threads place the blame squarely on PS3 users for making ‘logic leaps’ or ‘assuming’.  However you seem to be ‘assuming’ that everyone is instantly aware of the business dealings of Activision.  You have also made a ‘logic leap’ in believing that this constitutes transparency on Activisions part. 
    What would have solved the issue of people saying they have been mis-sold Elite Premium, is if Activision would have stated clearly in the advertising prior to release, and more importantly at point of sale for Elite Premium, that content would be staggered.  So then when people saw ‘you will receive content first’, they then would have also seen that the codicil to this was ‘if you have an XBOX’.  I and most people on hear believe that this is solely Activisions fault, and they have been mis-sold Elite Premium.  While you disagree; the sheer numbers of complaints should surely point to the fact that there was a lack of clarity. It should have been Activisions responsibility to make this clear. 
    Me, well I want my money back for Elite Premium as I believe ‘you will get content first’ should mean just that.  I have a refund case in with Sony to that effect, and when I have my money back I’ll trade the game and buy something else.  I won’t be buying any Activision products in the future, as I believe if a company is relying on smoke and mirrors to avoid its responsibilities to its customers, then I don’t want to have dealings with them.
    Elite Premium on PS3 should really be re-name Elite Second Class, and should be priced accordingly.

    Why would you punish yourself and deprive yourself of a game you clearly enjoy just to make a point to Activision?  Send them a snail mail letter airing your grievance instead.  You will feel better and you can still play MW3 (with all its flaws, the best COD yet, IMHO).   As an added bonus, your letter may be one of many that lead Activision to not renew their exclusivity deal with Microsoft.  Good luck.     No. There will be $60 worth of releases for non-premium, probably in 3/4 map packs with 2/3 months worth of elite maps in each so they will start in March, atleast a week after Premium PS3 players

    Non Premium members wont get it ‘day 60′. They can only get it in map packs. The Xbox map pack is expected to be out in March so I assume the non premium PS3 content will be out in April.
    If Day 1 = Jan 24Day 30 = Feb 23Day 60 =March 24Day 90 =April 23 I expect it to be out more Day 90 than 60 for Non premium PS3 members

    Thanks for the article it must have taken sometime, I enjoyed reading it but I must ask, How do you feel about the Elite service and how it has turned out for all of us disregarding the whole DLC issue? I am talking about the poor setup, the flaws the fact that we have no clan ops as of yet! What is your view on this?

    Sorry dude but thats utter crap. the elite was advertised as starting in january regardless of platform. then a month after elite was active activision suddenly posts on fb that the content drop is only for 360. heck even their support page didn’t have the info up until after ps3 owners were duped into getting elite. Activision messed up bad and its time they admit it instead of hiding behind people like you and that contract.
